The legal framework. Keep it simple.

1. Overview

This website is operated by Bradley Howe trading as Urban Basics ("we", "us", "our"), a sole trader established in England and Wales.

2. Made-to-Order Production & Your Right to Cancel

2.1 All products are manufactured individually upon receipt of your order. Production begins promptly after order confirmation.

2.2 Standard catalogue products (pre-existing designs, standard sizes and colours). Where you order a product from our standard catalogue — selecting only a pre-existing design, size, and colour that we offer — you have the right to cancel your order within 14 days of delivery without giving any reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Full details of how to exercise this right are set out in our Returns Policy. Because garments are manufactured to order, we ask that you review the size guide carefully before purchase; we cannot guarantee your cancellation right will result in no production cost to us, but we will honour the statutory right.

2.3 Customised products (consumer-supplied artwork or text). Where a product is made to your specific personal specifications — for example, where you supply artwork, custom text, or a design unique to you — the right to cancel under Regulation 28(1)(b) of the Consumer Contracts Regulations 2013 does not apply once production has begun, because the goods are made to your individual specification. You will be informed of this at the point of purchase and asked to confirm your acknowledgement before placing your order.

2.4 To fulfil your order, we share your name, delivery address, and order details with our fulfilment partner, Gelato AS (Norway), which routes your order to a print facility near you. Gelato and its print partners may be located outside the United Kingdom. Your delivery address and contact details will be processed in accordance with our Privacy Policy. Couriers engaged to deliver your order act as independent data controllers for their own logistics processing; their privacy notices govern that processing.

2.5 Nothing in this clause affects your statutory rights in respect of defective, misdescribed, or non-conforming goods under the Consumer Rights Act 2015.

3. Returns, Replacements & Statutory Rights

3.1 Our returns policy is strictly aligned with our custom production model. We do not accept returns or exchanges for changes of mind or incorrect sizes for personalised products. For standard products, you have a 14-day cancellation right.

3.2 If an item arrives damaged, features a manufacturing defect, or is incorrect, we will replace it or issue a refund. You must contact us within 30 days of delivery with clear photos of the issue. Full details can be found on our Returns Policy page.

3.3 Statutory rights on defective goods. If an item does not conform to the contract (e.g. it is not of satisfactory quality, not fit for purpose, or not as described), you have the following rights under the Consumer Rights Act 2015:

Within 30 days of delivery: the right to reject the goods and receive a full refund.
After 30 days but within 6 months of delivery: we are entitled to attempt one repair or replacement. If this fails or is not possible, you may claim a full or partial refund.
After 6 months: you may still claim, but you will need to demonstrate that the fault existed at the time of delivery.

These rights are not affected by our returns policy or any other term of this contract.

4. Shipping, Customs & Delivery

4.1 We route orders to the print facility nearest to your delivery address where possible. Estimated delivery times are set out at checkout and are estimates only.

4.2 Customs duties and import taxes. International orders may be subject to customs duties or import taxes levied by your local government. You are responsible for these charges. We will disclose estimated delivery costs and applicable charges at checkout before you place your order.

4.3 Address errors. If you provide an incorrect or insufficient delivery address and a shipment is lost or destroyed as a direct result, you will be responsible for the cost of a replacement order at the price applicable at the time of reorder. We will take reasonable steps to redirect a shipment if you notify us before it is dispatched.

4.4 Unclaimed packages. If a correctly addressed package is held for collection and goes unclaimed, and is subsequently disposed of by the courier, we will assess whether the failure to collect was attributable to you or to the courier's process before determining liability. Where the failure is primarily attributable to the courier, we will seek resolution with the courier in the first instance. Where it is primarily attributable to you, we may require the cost of a replacement order.

4.5 Nothing in this clause limits your rights under the Consumer Rights Act 2015 where goods are lost, damaged in transit, or not delivered within any agreed time frame.

5. Intellectual Property & Customer Content

5.1 All designs, graphics, and content on this website are our intellectual property. Purchasing a product does not grant you the right to reproduce, resell, or use our designs for any commercial purpose.

5.2 If you upload artwork, images, or text for printing on a product, you represent and warrant that: (a) you own or have a valid licence to use the content; (b) the content does not infringe any third party's intellectual property rights; and (c) the content is not unlawful, defamatory, or otherwise prohibited.

5.3 You indemnify Urban Basics against any third-party claim arising from your content. Urban Basics reserves the right to refuse any order that, in its reasonable opinion, infringes the above.

6. Pricing & Service

6.1 Prices displayed on the website are inclusive of UK VAT where applicable and may change at any time. Any change in price does not affect an order that has already been accepted by us.

6.2 We reserve the right to modify or discontinue the Service or any part of it with reasonable notice where practicable. We will not be liable for any such modification or discontinuation except where it constitutes a breach of a contract we have already entered into with you.

7. Accuracy of Billing & Account Information

We reserve the right to refuse any order you place with us. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information so that we can complete your transactions and contact you as needed. You may correct order information within a defined short window before production begins by contacting us immediately.

8. Limitation of Liability

To the maximum extent permitted by law, Urban Basics' total liability to you in connection with any order shall not exceed the price paid by you for the relevant order (including delivery charges).

Urban Basics is not liable for any indirect, consequential, or economic loss (including loss of profit or loss of data) arising from your use of the site or our products, except to the extent such loss arises from our fraud, wilful misconduct, or negligence causing death or personal injury.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including your statutory rights under the Consumer Rights Act 2015.

9. Force Majeure

Neither party will be liable for failure or delay in performance caused by circumstances beyond their reasonable control, including acts of God, extreme weather, pandemic, civil unrest, governmental action, carrier delays, or failure of third-party infrastructure (including Gelato's print network or shipping carriers). We will notify you promptly if such an event affects your order and will offer a revised delivery date or, where performance is impossible, a full refund.

10. Acceptable Use

You agree not to use the site to: (a) make fraudulent orders; (b) conduct scraping, data mining, or automated access without our consent; (c) upload unlawful content; (d) impersonate another person.

We may suspend or terminate your account immediately if we reasonably believe you are in breach of these Terms, subject to providing you with notice and an opportunity to respond where practicable. Termination does not affect any accrued rights.

11. Dispute Resolution

If you have a complaint about an order or our service, please contact us first at admin@urbanbasics.co.uk or via our contact form. We aim to resolve all complaints within 14 days.

If we cannot resolve your complaint, you may refer it to an approved Alternative Dispute Resolution (ADR) scheme. We are not currently a member of an ADR scheme.

For EU consumers: We are required to inform you that an ADR process exists in your country of residence. Please refer to the competent ADR body in your jurisdiction for details.

Nothing in this clause affects your right to take legal proceedings.

12. Age and Capacity

By placing an order you confirm that you are at least 18 years of age, or that you are placing the order with the consent of a parent or legal guardian. We do not knowingly process personal data of children under 13 without parental consent.

13. Pricing and VAT

All prices on this website are displayed in GBP and are inclusive of UK VAT where applicable. Prices are correct at the time of display but may change before an order is placed. The price confirmed in your order confirmation is the price you will pay.

International customers may be subject to local import duties and taxes, which are not included in our prices and are your responsibility.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. For consumers resident in the European Union, these Terms do not affect any mandatory consumer rights protections to which you are entitled under the laws of your country of residence.

Any dispute arising from these Terms that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of England and Wales, save that if you are a consumer resident in a jurisdiction that entitles you to bring proceedings in your local courts, you retain that right.
